and oil and rigged containers to explode. james holmes' apartment is at the top and according to an fbi bob technician, he said that holmes told him that he took a boom box and remote control car and placed it outside of a garage car. he said there was a cd that he made. the first 40 minutes was silent to timed out to start playing very loud music. holmes hoped that somebody would come over to that trash bag and then see the remote control car and start playing with it. except that remote control was was not triggered to move the car. it was triggered to set off a device inside the apartment and that would trigger a much larger explosion. according to the fbi bomb technician, james holmes planned to have his apartment explode to distract and overwhelm first responders and he would walk into the theater a few miles away and start shooting. it's the kind of elaborate diabolical plot that seems to work for villains in a batman movie but in real life this diabolical part of the plan didn't work. and, wolf, investigators also testified today that in the month leading up to the shooting james

interested in what we were doing, and so the assistant director of the fbi for counter-terrorism came to west point and said the fbi could benefit from this kind of education as well. and so they asked west point to go and expand our education for cadets to what we now call practitioner education. we send people from west point and combating and they teach each new about a boc of instruction on terrorism to reinforce the things that are taught at the f.b.i. academy. we also send them out around the nation to be able to work with joint terrorism task forces, which is not just f.b.i. people, but also law enforcement and others to educate them on the terrorist threat and the changes. and then creating a virtual network because of the connections of everybody on the internet so that when pracktigsners that are out there in police departments or the f.b.i. are studying a particular case or aspect of terrorism they can reach back into the literature and research at west point and get a little bit more expertise and the history and the background and the theory that they're able to do. >> what kind

of a retired fbi agent who disappeared in iran almost six years ago has released photos of him in captivity. they show him in an orange jump suit holding various signs, one of them read, why you cannot help me. the family spokesman said the photos were received 18 months ago because they haven't seen enough progress in the case. his family says he was working an a private investigator looking into cigarette smuggling when he went missing on a business trip. the fbi has offered a million dollar reward for information leading to his safe return. >>> it is now confirmed that chavez will not be attending his inauguration. tomorrow is the big day but the 58-year-old president has been undergoing cancer treatment in cuba. so he can't take the oath of office in person. that has been raising questions about his legitimacy. the constitution isn't clear on whether the president can be sworn in on another day or who should be in charge in the meantime. the ruling has been issued by the supreme court there. he did leave for a fourth cancer surgery in cuba last month. he has since been battling a severe
control laws, but to strengthen things like databases the fbi uses for background checks or getting states to share more information from criminal and mental health databases or even prosecuting felons who try to buy guns illegally or people who lie on background checks. would you support any of those moves? >> you have to look at each one one by one. a number of them, for example, the mental health issues, for example, i strongly favor, looking at those actions. if they're within the law and it's an appropriate executive order, i think the president has every right to do it. if it's not in current law, he can't do it by executive order and the congress would have to, i think, block him if he attempted to do it by executive order. it depends on exactly what they come up with. what i really encourage is that the vice president before he rushed around doing new things, go to chicago. chicago has very strict gun laws. it is also the deadliest city in america, over 500 people were killed in chicago last year. and i think the vice president ought to ask the question himself, why is it that all
the libyans or the f.b.i. the agents didn't allow for this. today surprisingly his lawyer appeared before a judge and said there was insufficient evidence to hold him and he was subsequently released even though members of congress and others have said they believe he was involved in the attack. so it's really raised questions not only about his case but where the investigation broadly stands nearly four months after the attack libyan authorities say that they have had a problem arresting people that while they have suspects they have -- the authorities are afraid to arrest people because of their ties to the militias and so this case really raises broader questions about the status of the investigation into the attack that killed ambassador stevens and three other americans. >> i want to get to those broader questions but a logistical one first hichlt is it that a tunisian ends up being a suspect and he's being held in tunis for an attack that allegedly occurred in libya. >> according to the investigators we've spoken to there were upwards of 70 people involved in that attack and they we
